Opinion Title:Among other disputed facts, the issue of the existence or non existence of the restrictive covenant, the issue of its enforceability are all clearly genuine issues of material facts which must necessarily be decided by the trier in this case.
Summary judgment would be totally inappropriate in this case (See also Defendant’s Request for Leave to Amend Answer and Defendant’s Memorandum in Opposition to Motion (#122)).
