MEMORANDUM OF DECISION MOTION FOR ARTICULATION
OLIVER, J.

The court, in a memorandum of decision dated June 15, 2011, entered judgment for the plaintiff against the defendant LLC on the first four counts of the civil complaint. The court entered judgment for the individual defendants on the remaining counts. On the counterclaim, the court entered judgment in favor of the defendants/counterclaim plaintiffs against the plaintiff/counterclaim defendant, The Cast Iron Associates, LLC. The court ordered the matter continued for a hearing in damages.

The plaintiff / counterclaim defendant, on June 21, 2011, filed a motion for articulation seeking clarity on issues related to the memorandum of decision.

I. Final Judgment
The court will enter a final judgment in this matter after the hearing in damages to be conducted in the immediate future. This final judgment will include an award of damages, costs, fees and where applicable, attorney’s fees. The final judgment will also include a default judgment with an award of damages, fees and costs as to the defendant LLC.

II. Plaintiff’s Right to Recover
The court’s memorandum of decision dated June 15, 2011 allows for the plaintiff to recover damages, fees and costs against the defaulted defendant, Niro Career Services, LLC. The decision precludes the plaintiffs recovery of damages against the individual defendants based on the personal guaranty. The decision allows for the recovery of damages by the defendants/counterclaim plaintiffs CT Page 12406 against the plaintiff/counterclaim defendant. CT Page 12407
