MEMORANDUM OF DECISION
ROBERT I. BERDON, Judge Trial Referee.

In September 2006, the parties entered into an agreement prepared by the defendant whereby the defendant was to construct a parking lot with drainage which provided in part for a “1 year warranty on labor and materials.”

Almost immediately after completion, there was excessive water accumulation in the lot. After contacting the defendant and requesting remediation of the problem, the defendant failed to resolve the problem. The costs to correct the drainage is estimated to be $4,600.00.

Judgment may enter in favor of the plaintiff and against the defendant in the amount of $4,600.00 plus taxable costs.
