CASE NO. 619 CRD-7-87Workers’ Compensation Commission
APRIL 14, 1988
Claimant was represented by Frank DeNezzo, Esq., and Gerald R. Swirsky, Esq.
Respondents were represented by Kevin J. Maher, Esq., and Scott Wilson Williams, Esq.
This Petition for Review from the July 27, 1987 Finding and Award of the Commissioner for the Seventh District was heard March 25, 1988 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners Frank Verrilli and A. Thomas White, Jr.
DISMISSAL OF APPEAL
JOHN ARCUDI, Chairman.
Respondents filed a Petition for Review August 6, 1987 from the July 27, 1987 Finding and Award of the Seventh District Commissioner. On that same date respondents filed a Motion for Extension of Time to File Reasons of Appeal. The Chairman of the Workers’ Compensation Commission in his capacity as the presiding administrative commissioner of the Compensation Review Division granted said Motion August 11, 1987 until four (4) weeks after the trial commissioner’s ruling on respondents’ Motion to Correct.
The trial commissioner denied the respondents Motion to Correct in his order of September 9, 1987. Claimant filed a Motion to Dismiss on October 19, 1987 based on respondent’s failure to file Reasons of Appeal within four (4) weeks of the ruling on its Motion to Correct.
Claimant’s Motion to Dismiss was filed within the proper time permitted by Practice Book 4056 as directed by the Appellate Court’s decision in Sager v. GAB Business Services, Inc., 11 Conn. App. 693 (1987).
We therefore dismiss respondent’s appeal, Administrative Regulation 31-301-2; Emmens v. Southbury Food Center, 3 Conn. Workers’ Comp. Rev. Op. 73, 455 CRD-5-86 (1986).
Commissioners Frank Verrilli and A. Thomas White, Jr. concur.
