573 A.2d 356
(8426)Appellate Court of Connecticut
SPALLONE, NORCOTT and LAVERY, Js.
Argued April 17, 1990
Decision released April 18, 1990
Action to foreclose a mortgage on certain real property owned by the named defendant et al., brought to the Superior Court in the judicial district of Stamford-Norwalk and tried to the court, Cioffi, J.; judgment of foreclosure by sale; thereafter, the court, Landau, J., granted the plaintiffs’ motion to open the judgment to set a new sale date, and the named defendant appealed to this Court. Appeal dismissed; judgment directed.
Patricia Kane, pro se, the appellant (named defendant).
Rudra Tamm, for the appellees (plaintiffs).
PER CURIAM.
After oral argument, both parties concede that the issues raised in the named defendant’s appeal from the trial court’s granting of the plaintiffs’ motion to extend the sale date, now past, in the underlying foreclosure action are now moot.
The appeal is dismissed and the case is remanded to the trial court for a new sale date to be set.
