The claimant was represented by Karen Fox, Esq.
The respondents were represented by Scott Wilson Williams, Esq. of the Law Office of Kevin J. Maher.
This Petition for Review from the February 19, 1987 Finding and Dismissal of the Commissioner for the Seventh District was heard June 7-4, 1988 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners A. Paul Berte and Robin Waller.
FINDING AND DISMISSAL
The Seventh District Finding and Dismissal of February 19, 1987 is hereby affirmed and adopted as the Finding and Dismissal of this Division.
OPINION
JOHN ARCUDI, Chairman.
Claimant seeks reversal of the Seventh District’s February 19, 1987 Finding and Dismissal[1] . Our review is limited to questions of law as no Motion to Correct has been filed, Mack v. Blake Drug Co., 152 Conn. 523
(1965). The only question is whether there was evidence to support the trial Commissioner’s finding and whether the conclusion was contrary to law, Fair v. People’s Savings Bank, 207 Conn. 535 (1988).
There was evidence below from claimant’s medical witness, pulmonary specialist Dr. Eric Jimenez of Danbury, that claimant’s lung disability resulted from conditions at work. The respondents’ specialist, Dr. Jonathan M. Gordon, disagreed. The Commissioner could have credited or not credited either opinion in whole or in part. He considered all the evidence and concluded claimant had not met his burden of proof. We will not disturb that conclusion as there was evidence to support the result and it was not contrary to law.
We, therefore, affirm the Finding and Dismissal of the Seventh District Commissioner.
Commissioners A. Paul Berte and Robin Waller concur.
