ROBERT MACK, CLAIMANT-APPELLEE v. STATE OF CONNECTICUT, DEPARTMENT OF CORRECTION, SELF-INSURED EMPLOYER, RESPONDENT-APPELLANT.

CASE NO. 4589 CRB-1-02-11 CLAIM NO. 100002556Compensation Review Board WORKERS’ COMPENSATION COMMISSION
JANUARY 8, 2003

ORDER
JOHN A. MASTROPIETRO, CHAIRMAN.

The respondent State of Connecticut, Department of Correction has filed a Petition for Review from the trial commissioner’s November 7, 2002 31-308a Order. That order was issued as the result of an informal hearing. No transcript or exhibits exist. Thus, there is no record for this board to properly consider this appeal under Sec. 31-301. Consequently, this matter is not ripe for appellate review. The matter is therefore remanded to the First District for a formal hearing or other appropriate action. See Fiamma v. Moliterno Stone Sales, 4465 CRB-1-01-12
(December 20, 2001); Lirot v. Mashantucket Pequot Gaming, 3400 CRB-2-96-8
(April 7, 1997); Muldoon v. New England Installation, 3416 CRB-4-96-8
(November 3, 1997).
