JUDGMENT
JOSEPH T. GORMLEY, JUDGE TRIAL REFEREE.

This case was set down for a trial on June 28, 2006. Notice of that trial date was sent to both parties. The defendant, Jo-Ellen Mumford did not appear and upon motion made by the plaintiff the court defaulted the defendant. The court proceeded directly to a Hearing in Damages.

The only count in this case is a claim of statutory theft under C.G.S. § 52-564. The plaintiff is seeking treble damages. The value of the property stolen was testified to as $49,125 × 3 equals $147,375.

Judgment may enter in that amount against the defendant. The defendant’s conduct in this case was totally egregious and without any color of right. She violated a direct order of Probate Court. Based upon an affidavit submitted by plaintiff’s counsel the court will award counsel fees and disbursements in the amount of $9,270.75. CT Page 12372
