DISMISSAL OF APPEAL

In the above captioned matter the Commissioner for the Fourth District issued a Finding and Award December 27, 1990. The respondents filed a Petition for Review January 4, 1991. The appeal was set down for oral argument before a Compensation Review Division panel consisting of Commissioners John Arcudi, Gerald Kolinsky and Donald H. Doyle November 22, 1991.

The parties did not appear for oral argument on that date as they were negotiating a settlement. A final settlement of all claims between the parties was entered into and approved by the Fourth District December 12, 1991.

As all issues raised by the respondents’ petition have therefore become moot, the appeal is dismissed with prejudice. John Arcudi, Commissioner For the three commissioner C.R.D. panel
