GEORGE SPRAGG, CLAIMANT-APPELLEE vs. CITY OF WEST HAVEN, EMPLOYER, RESPONDENT-APPELLANT

CASE NO. 125 CRD-3-82Workers’ Compensation Commission
JULY 27, 1984

The Claimant-Appellee was represented by Charles L. Flynn, Esq.

The Respondent-Appellant was represented by Edward Gallant, Esq.

This Petition for Review from the January 18, 1982 Denial of Respondent’s Motion To Reopen and Vacate by the Commissioner for the Third District was argued April 29, 1983 before a Compensation Review Division Panel consisting of the Commission Chairman, John Arcudi, and Commissioners A. Paul Berte and Robin Waller.

OPINION

JOHN ARCUDI, Chairman.

The instant matter is an appeal from the district commissioner’s January 18, 1982 decision denying respondent’s June 8, 1981 “Motion to Reopen and Vacate” an award of March 1, 1976 and October 20, 1978.

For reasons discussed in Cuccuro v. West Haven, 103 CRD-3-81, issued today, the decision of the Commissioner denying the motion is affirmed.

Commissioners Berte and Waller concur in this opinion.
