This Petition for Review from the April 21, 1995 Finding and Dismissal of the Commissioner acting for the Third District was heard March 15, 1996 before a Compensation Review Board panel consisting of the Commission Chairman Jesse M. Frankl and Commissioners Michael S. Miles and Robin L. Wilson.

RULING ON RESPONDENTS’ MOTION TO DISMISS

JESSE M. FRANKL, CHAIRMAN.

The claimant filed a timely appeal on May 1, 1995 from the April 21, 1995 Finding and Dismissal of the Commissioner acting for the Third District. The respondents filed a Motion to Dismiss the claimant’s appeal based upon the claimant’s failure to prosecute her appeal with due diligence.

On March 15, 1996, this board issued a bench ruling denying the respondents’ motion to dismiss. See Molbury v. MidwestDrivers Corporation, 10 Conn. Workers’ Comp. Rev. Op. 202, 1278 CRD-7-91-8 (Nov. 12, 1992) The merits of the claimant’s appeal will be scheduled to be heard by the Compensation Review Board.

Commissioners Michael S. Miles and Robin L. Wilson concur.
